In February 2023, the former government and other jurisdictions agreed to amend WHS laws, enabling industrial manslaughter legislation.
Industrial manslaughter laws hold corporations liable for employee-caused workplace deaths. Manslaughter, as defined, pertains to the unlawful killing of a human being.
SafeWork will launch a broad consultation with WHS experts, industry, unions, legal professionals, and affected families.
The NSW Government has completed the formal consultation process, with plans to subsequently present a bill to parliament in 2024.
Every NSW worker deserves a safe workplace, and these laws aim to strengthen safety across the state.
Minister Sophie Cotsis hopes the laws deter breaches so effectively that prosecutions become unnecessary. We must strive to prevent fatal injuries in the workplace.“
She further emphasised the significance of the penalties, recognising the profound pain and anguish endured by the families and loved ones of workers who have tragically perished in preventable workplace accidents.
