The NSW Government is seeking to simplify Dispute resolution across CTP & Workers Compensation. The NSW Standing Committee on Law & Justice has commenced a review to assess the feasibility of a consolidated personal injury tribunal. .
The Workers Compensation Commission (WCC)
Workers’ Compensation Commission (WCC) is an independent tribunal that helps resolve workers’ compensation disputes between injured workers, employers, and insurers. If an injured worker disagrees with an insurer’s initial decision, they may request a review. If they remain dissatisfied after that review, they can lodge an application with the WCC to have the dispute resolved.
The kind of disputes they resolve includes:
- weekly payments and compensation
- medical, hospital and related expenses
- permanent impairment compensation
- compensation for death of a worker
- compensation for damage to personal property
- compensation for domestic assistance.
In 2017 the NSW Standing Committee on Law and Justice conducted a comprehensive review of the NSW workers compensation scheme with a total of 26 recommendations being made to the NSW Government. One of these recommendations was that a consolidated personal injury tribunal for Compulsory Third Party and workers compensation dispute resolution be established.
On 1 May 2018 the NSW Standing Committee on Law and Justice commenced a review to look into the feasibility of a consolidated personal injury tribunal for Compulsory Third Party and workers compensation dispute resolution as suggested by the scheme review. This review will look at things such as the legislative changes that would be required to have a consolidated approach, possible model and where the tribunal should be located.
