The NSW Supreme Court has found an employer liable where an employee who while travelling home from his workplace suffered severe injuries. The Supreme Court said they were satisfies the company’s duty of care extended beyond its employees’ work works and workplace.

Under Work Health & Safety Act, Platforms (deemed a PCBU) must ensure risks are eliminated or controlled, includes features of the app or the delivery process that can create a risk to rider/drivers health and safety. From 1 July 2022, in keeping food delivery riders safe, they must be provided Personal Protective Equipment (PPE) required to do their job safely.

NSW Parliament recently approved changes to workers compensation and motor accidents legislation to provide greater support to volunteers, children of those involved in fatal workplace accidents and road users. Customer Service and Digital Government Minister Victor Dominello believes the changes are important step forward.
